It's a start

"Casting an unmistakable and perhaps permanent pockmark on the face of the Obama administration, a federal judge in Virginia ruled Monday that a major component of the new health care reform law is unconstitutional."

  1. I just finihsed the memorandum opinion. It's an interesting read. Not as entertaining as Scalia or Thomas -- it has neither the ascerbic bite of Scalia's "lemon juice in razor cuts" delivery, nor the sweeping philosophy of Thomas. A very workmanlike fisking. (Maybe a "Robertsesque" opinion? Constitutional lawyers, chime in with your characterizations.)

The opinion I'd like to see is one that explains why Congress has no remaining authority to regulate the details of health insurance under the Commerce Clause, since DECADES ago, they prohibited any interstate commerce in health insurance anyway. . .

  2. "Constitutional lawyers, chime in ..."

I appreciate your vote of confidence, but somehow I don't see scads of Constitutional lawyers amongst my tens and tens of readers. *grin*
